Who can hold sweepstakes and raffles
Many of you here already know that every year we draw a completely personalized vehicle at the Official Truck® promotion. But did you know that not everyone can do the draw as they please?
The general rule indicates that a Commercial Promotion Authorization Certificate issued by the Ministry of Finance is mandatory and Law No. 5.768 states in its article 4: “no natural or legal person may distribute or promise to distribute prizes through sweepstakes, gift certificates, contests or similar operations, outside of the cases and conditions provided for in this law”.
In recent days we have come across some news about the subject on the internet. The title of the article on the UOL website is: "Car raffle: influencers use networks to profit from illegal raffles…"
Analyzing these cases and conditions, we think that we are on the right path. Imagine a hypothetical situation: you buy a raffle ticket for a vehicle and it does not comply with all the determinations of the Ministry of Finance/SECAP (Secretariat of Evaluation, Planning, Energy and Lottery) and the draw is cancelled. What would do? Would you lose your money? Would you be injured?
The ministry says that, if there is proof of losses to any participant, a criminal offense may be constituted or, "at least", injury to the consumer. “Illegal activity does not include any guarantees to the participating public in order to prevent the most varied forms of manipulation or fraud of results”, adds the agency.
Does the Official Truck® meet all the requirements set out by law?
